The domain name www.Exporttex.com (referred to as "Website") is owned by "EXPORT TEX" a company incorporated under the Companies Act, 1994(Act XVIII of 1994).

These Products can be bought through the Website using various payment methods. Once you place an order, Exporttex.com will ship the product to you, and you are responsible for making the payment.

The User consents, acknowledges, and agrees that they have read and fully understand the Privacy Policy of Exporttex.com. The User also agrees that the terms and contents of this Privacy Policy are acceptable to them.

Limited User

Discount Policy

Users can avail of only one method of discount at a time (free delivery, coupon discount, payment gateway discount).

• If your cart includes a product with free delivery, the coupon discount will only be applied to products that do not have free delivery.
• If a customer uses a payment gateway that provides a discount, a coupon discount will not be applicable.

Product Description

Exporttex.com strives for accuracy but does not guarantee that product descriptions or other site content are accurate, complete, reliable, current, or error-free. If a product from Exporttex.com does not match its description, your only remedy is to return it in unused condition.

Abusing Exporttex.com

Order Acceptance and Pricing

Please be aware that there are situations where an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order at any time, for any reason. We strive to provide accurate pricing information on the Site, but errors can occur, such as an incorrect price being displayed. In such cases, we reserve the right to refuse or cancel any order. If an item is mispriced, we may, at our discretion, either contact you for further instructions or cancel your order and notify you of the cancellation. We have the right to refuse or cancel any orders, whether or not the order has been confirmed and your debit/credit card charged.

All prices listed on this website are subject to change without notice. The prices in effect at the time of placing an order will apply. The posted prices include all taxes and charges. If there are any additional charges or taxes, they will be specified on the website.

Regarding the product customization Service (unlike other Services such as blogs and forums), you expressly agree that by uploading and posting content on the Website for public viewing and reproduction or use by third-party users, you grant a non-exclusive license for its use.

Return & Replacement Policy

It is uncommon for Export Tex customers to receive products that are damaged. However, there may be instances where we do not meet your expectations, as sometimes circumstances are beyond our control. Despite this, there is a strong bond of trust between our customers and Export Tex. To reinforce and encourage this trust, Exporttex.com offers the option to return products if they are damaged or incorrectly designed. In such cases, Export Tex will provide you with new products in exchange.

If for any reason you are unsatisfied with your order, you may return it as long as your item meets the following criteria:

• It is within 03 Days from the delivery date.
• To be eligible for a return or exchange, all items must be unused and in their original condition. This includes keeping all original tags and packaging intact, without any damage or tampering.
• If the item included a free promotional item, the free item must also be returned.
• Refunds or replacements for products are contingent upon inspection and evaluation by the Export Tex team.
• Replacements are dependent on the availability of stock from the Supplier. If the product is out of stock, you will receive a full refund, no questions asked.
• Please be aware that the Cash on Delivery convenience fee and the shipping cost are non-refundable, and therefore, will not be included in the refund amount of your order.

Reasons for returns & replacement

• The product is damaged, defective, or not as described.
• Size mismatch for clothing items will only be addressed if the size delivered differs from what is stated on the invoice. If the invoice and the delivered item's size are the same, we will not offer a refund under any circumstances.
• Color Mismatch for clothing.
• Wrongly Printed clothing.(Front/Back desgin mismatch, wrong design, wrong placement of design)
• The wrong product was sent.

How to return:

Contact Export Tex Customer Care team by emailing contact@exporttex.com within 03 days after receiving your order.

After we pick up or receive your returned item, we will conduct a quality check on the product. If the reason for the return is deemed valid, we will either replace the product with a new one or issue a refund.

Refund Policy

• The refund will be processed after we have completed evaluating your return.
• Replacement is subject to availability of stock with the Supplier. If the product is out of stock, you will receive a full refund, no questions asked.
• Please note that the Cash on Delivery convenience charge and the shipping charge would not be included in the refund value of your order as these are non-refundable charges.
• If you have selected Cash on Delivery (COD), there is no amount to refund because you haven't paid for your order.
• For payments made using a Credit Card, Debit Card, Mobile Banking, or Bank Transfer, you will receive a refund in your respective.
• If online payment is made once more due to a technical error, a payment refund will be made.
• You will receive a refund anytime between 7-10 working days. If you don't receive a refund within this time, please write to us at contact@exporttex.com and we shall investigate.

Order Cancellation

You will receive a phone confirmation after placing an order. If you wish, you can cancel the order at that time. However, once you agree to receive the product during the confirmation call, you may no longer be able to cancel your order.

If you have selected Cash on Delivery (COD), there is no amount to refund because you haven't paid for your order.

For payments made with a Credit Card, Debit Card, Mobile Banking, or Bank Transfer, you will receive a refund to the respective account once your order is canceled. The full amount of your order will be refunded.

Governing Law

These terms will be governed and interpreted according to the laws of Bangladesh, without considering conflict of laws principles. Any disputes related to these terms will be under the exclusive jurisdiction of the courts in Dhaka.

Legal Disputes

If a dispute arises between you and Exporttex.com, we aim to provide a neutral and cost-effective way to resolve it promptly. Therefore, you and 'Exporttex.com' agree to resolve any legal or equitable claim related to this Agreement or our services according to the methods outlined below or as mutually agreed upon in writing. Before using these options, we encourage you to contact us directly to seek a resolution. We are open to considering reasonable requests for alternative dispute resolution methods, such as arbitration, as alternatives to litigation.

APPLICABLE LAW AND JURISDICTION: These Terms and Conditions shall be interpreted and governed by the laws in force in Bangladesh. Subject to the Arbitration section below, each party hereby agrees to submit to the jurisdiction of the courts of Dhaka.

ARBITRATION: Any controversy, claim, or dispute arising out of or relating to these Terms and Conditions will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Dhaka, Bangladesh. The arbitrator shall be a person who is legally trained has experience in the information technology field in Dhaka and is independent of either party. Notwithstanding the foregoing, the Site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

Unauthorized Charges on your card

If you notice charges on your credit/debit card for purchases on Exporttex.com but never created an account or signed up, please first check with any family members or colleagues who may be authorized to make purchases on your behalf to confirm they did not place the order. If you still cannot identify the charge, please report the unauthorized purchase within 60 days of the transaction so that Exporttex.com can start an investigation.

Cancellation of Fraudulent/Loss to business Orders

To ensure a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. If we detect any suspicious activity, Exporttex.com reserves the right to cancel all past, pending, and future orders without liability. We also reserve the right to refuse or cancel orders in cases of pricing errors on the website or product unavailability. Additional verifications or information may be required before we accept an order. If your order, or any part of it, is canceled, or if we need more information to proceed, we will contact you. If your order is canceled after your card has been charged, the amount will be refunded to your Card Account. Please note that any promotional voucher used for canceled orders may not be refundable.

The customer may be considered fraudulent if any of the following scenarios are met:

• The customer doesn't reply to the payment verification mail sent by Exporttex.com
• The customer fails to produce adequate documents during the payment details verification
• Misuse of another customer's phone/email
• The customer uses an invalid email and phone no.
• The customer returns the wrong product
• The Customer refuses to pay for an order
• The customer is involved in the snatch and run for any order

Indemnifications

You agree to indemnify, defend, and hold harmless Exporttex.com from any losses, liabilities, claims, damages, costs, and expenses (including legal fees and related expenses and any interest charged on them) that arise from, result from, or may be payable due to any breach or failure to fulfill any representation, warranty, covenant, agreement, or obligation you have under these Terms.

Disclaimer of Warranties/Limitation of Liability

Exporttex.com has made efforts to ensure the information on the Website is accurate, but does not guarantee the quality, accuracy, or completeness of any data, information, product, or service provided. Exporttex.com shall not be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any other damages resulting from (a) the use or inability to use the services or products; (b) unauthorized access to or alteration of user's data or transmissions; (c) any other issue related to the services. This includes, but is not limited to, damages for loss of use, data, or profits arising from the use or performance of the Website or its services. Exporttex.com is also not responsible for delays or inability to use the Website, the provision or failure to provide services, or for any information, software, products, services, and related graphics obtained through the Website. This applies regardless of the legal theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise. Additionally, Exporttex.com is not liable for the Website being unavailable during maintenance or due to technical issues beyond its control. Users acknowledge that any material or data downloaded from the Website is done at their own risk, and they are solely responsible for any damage to their computer systems or data loss that results from such downloads.

Payment & Shipping

Exporttex.com offers Cash on Delivery (COD), Debit/Credit Card (VISA, Master Card, DBBL Nexus, etc.), and Mobile Banking (bKash, Rocket) as payment methods.

We will coordinate the shipping of the products to you, but please note that shipping schedules are only estimates and cannot be guaranteed. We are not responsible for any delays in shipment. Occasionally, deliveries may take longer due to adverse weather conditions, political disruptions, or other unexpected events. The title and risk of loss or damage are transferred to you upon delivery of the product.

Risk of Loss

All items bought from Exporttex.com are sold under a shipment contract, meaning that Exporttex.com bears the Risk of Loss until the item is delivered to you. Once you receive the items, any risk of damage shifts to you as the customer.

Fraud Protection Policy

Exporttex.com recognizes the importance of having robust fraud detection and resolution measures in place. Along with our online payment partners, we continuously monitor transactions for any suspicious activity, flagging potentially fraudulent transactions for our team to manually verify.

In extremely rare cases where our team cannot definitively rule out the possibility of fraud, the transaction is placed on hold, and the customer is asked to provide identification documents. These documents help us confirm that the purchases were made by the legitimate cardholder. We apologize for any inconvenience this may cause and ask for your understanding, as this measure is in place to ensure a safe and secure environment for online transactions.

Termination

Additionally, you will be entitled to any royalty payments that have accrued or are legally deemed to have accrued to you, by the User License Agreement.
